§1 Preamble

By visiting our website, you entrust us with your data, which we process for specific purposes, always with a concern for protecting your privacy. This Privacy Policy serves to help you understand what data we collect, for what purpose, and how we use it.

The information specified in this document is very important for you, as it addresses issues related to the processing of personal data, especially in view of the provisions of the personal data protection laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as "GDPR"). §2 General Information

What are personal data and what does their processing mean?

Personal data means information about an identified or identifiable natural person. Processing of personal data essentially includes any operation on personal data, whether automated or not, such as collection, storage, recording, organizing, modifying, viewing, using, sharing, restricting, deleting, or destroying. We process your personal data, as specified in this document, for various purposes, and during processing, different methods of collection, legal bases of processing, uses, disclosures, and storage periods, which are always specified in relation to the purpose for which the data are processed.

When does this Privacy Policy apply?

This privacy policy applies in all cases where we are the data controller and where we process personal data. This applies to cases where we process data obtained directly from the data subject and cases where we have obtained personal data from other sources.

How do we process personal data, on what legal basis, and what types of personal data?

To maintain transparency in the ways and legal bases of processing personal data, as well as the purposes for which we process personal data, we always provide necessary information in this regard to each person whose personal data we process. Following the principle stated above to make our explanation of these issues as clear as possible, we present in this document a compilation of personal data processing operations based on different legal bases of the processing process whenever we indicate the legal basis of the processing process based on the legitimate interest of the data controller, we strive to analyse and balance our interest and the potential impact of the process on the natural person concerned (both positive and negative consequences of the process) and the rights of the natural person arising from the regulations.

We declare that as the Data Controller, we do not process personal data based on our legitimate interest when we conclude that the impact on the person concerned would outweigh our interests (in which case we may process personal data if, for example, we have the appropriate consent or if required or permitted by law).

Individuals (clients, potential clients, employees) contacting (contact form) to obtain information about the offer or share comments regarding services or products, contacting to enter into a contract, and also individuals seeking employment,
Individuals (website users) using information about the company, services/products provided on the website www.

§4 Purpose and scope of data collection and data recipients

A natural person visiting the website or using services provided through the website electronically always has control over the personal data they provide to us.

Our website limits the collection and use of information about its users to the minimum necessary to provide services at the desired level, in accordance with Art. 18 of the Act of July 18, 2002, on providing services by electronic means.

Each time the purpose and scope of data processed by the Data Controller results from the necessary minimum related to the need to provide services to the user in cases of:

Tailoring the content of the site to the user's expectations,
Analyzing server operation problems, preventing potential violations, and ensuring website security,
Analyzing website visit statistics, including analyzing the demographic data of users visiting the site (information about the region and device from which the connection was made),
Actions taken by us on your behalf. For example, if you want to ask us a question, you may be asked to provide a specific range of personal data depending on the content of the selected issue.

What types of cookies do we use?

Two types of cookies may be used on the Site – "session" and "persistent". The former are temporary cookies that remain on your device until you leave the Site. Persistent cookies remain on your device much longer or until you manually delete them (how long a cookie remains on your device depends on the 'lifespan' of the cookie and your internet browser settings).

Purpose of collecting personal data

Website management, in terms of:

- Attachment.

We may also process anonymized operational data related to visiting our website (so-called logs – IP address, domain). These data help us generate statistics useful in administering the website. These data are collective and anonymous, i.e., they do not contain features that identify the individual user of the website, and Logs are not disclosed to third parties except for the possibility of sharing information regarding the IP number of the website user at the request of the authorized authority based on applicable laws, state bodies in connection with their proceedings.

Automated processing of personal data

The information we collect in connection with the use of our online services/products made available on the website may be processed in an automated manner (including profiling), however, this will not have any legal consequences for the natural person nor similarly significantly affect their situation. We pay special attention to profiling issues and indicate that:

for profiling purposes, we do not process any sensitive data,

we profile for marketing purposes, i.e., to tailor the marketing offer to www. preferences.

Data recipients

We do not share personal data with companies, organizations, or individuals outside of H4H Recruitment Maria Kasperkiewicz unless one of the following circumstances occurs:

The user has consented to such action - in this case, we share personal data with companies, organizations, and individuals outside of H4H Recruitment Maria Kasperkiewicz, if the user consents to it.
There are legal reasons – in this case, we share personal data with companies, organizations, and individuals outside of H4H Recruitment Maria Kasperkiewicz if we believe in good faith that access, use, preservation, or disclosure of the data is reasonably necessary in connection with:

§5 Legal bases for data processing

The legal basis for processing personal data is the premise:

processing is necessary for the performance of a contract to which the data subject is party, or to take steps at the request of the data subject before entering into a contract. This basis refers to data collected through the contact form, which has been made available on our website www. In this case, providing personal data is necessary to perform a specific action at your request according to the purpose of processing, e.g., if you do not provide us with an email address, we will not be able to respond to your query according to the content of the sent message.

We ask you not to provide information from special categories of personal data (such as information about race or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, information concerning physical or mental health, genetic data, biometric data, information about sexual life or sexual orientation, and criminal history) via the contact form. In the event of providing such information for some reason, we declare that as the Data Controller, to ensure transparency of data processing for a specific purpose, we will delete such content from the message, about which we will inform you at the indicated email address.

Your consent, for the processing of specific categories of data always for a specific purpose, for which we ask you to express e.g., a phone number in order to contact you on a specific topic of the sent message,
the necessity to realize legally justified purposes of the Data Controller, which are expressed through:

- adapting its content to your needs and expectations and ensuring the security of your data in cyberspace,
- marketing of own services and products.

§6 Processing time

Our goal is to protect you from the negative consequences of processing your personal data. In this regard, we have tried to optimize the retention time of your data collected through the website www. This time we have defined:

in the case where the Data Controller processes personal data based on consent, the processing period lasts until the user withdraws this consent;
in the case where the Data Controller processes personal data based on the legitimate interest of the data controller, the processing period lasts until the aforementioned interest ceases (e.g., the period of limitation of civil law claims) or until the person concerned objects to further such processing – in situations where such objection is legally permissible;
in the case where the Data Controller processes personal data because it is necessary due to applicable legal provisions, the periods for processing data for this purpose are defined by these provisions (this is, for example, the obligation according to the provisions of the law to keep the User's Personal Data for a longer period or if the User's Personal Data is needed to raise legal defences or take defence against legal claims, the company will keep the User's Personal Data until the end of the appropriate retention period or until the resolution of the subject claims);
in the absence of specific legal or contractual requirements, the basic period for data retention in the case of records and other evidence documentation prepared during the performance of the contract is a maximum of 5 years.

Cookies are small text information in the form of text files, sent by the server and saved on the side of the person visiting the website (e.g., on the hard drive of a computer, laptop, or on the memory card of a smartphone – depending on the device used by the visitor to our website www).

§8 Your rights

It is worth knowing what rights you have concerning the processing of your personal data:

At any time, you have the right to withdraw the consent given, which will cause the cessation of the processing of personal data processed based on the given consent. Withdrawal of consent does not affect the compliance of the processing of personal data, which we carried out based on the consent given before its withdrawal. You have the right to request the deletion (right to be forgotten) of your personal data from information systems and from files. This right will be implemented by the Administrator if there is no legal obligation on the Administrator to retain, and thus process, data despite submitting the right to be forgotten. You have the right of access to your data (request for a copy of the data). This right can be exercised by sending an email to the address: biuro@h4h.com.pl
You have the right to rectification (data update). We inform that updating the data will not cause the deletion of data before making the update, which is related to the obligation to maintain the consistency of the data processed by the Administrator for a specific purpose. This right can be exercised by sending an email to the address: biuro@h4h.com.pl
You have the right to restrict processing, including the right to object to data processing citing a specific situation. We inform that this right will be implemented by the Administrator only if the performance of a specific action is not contrary to the applicable legal provisions that oblige the Administrator to process data. Additionally, you have the right to transfer your data from IT systems to a designated entity and to file a complaint to the Supervisory Authority on the actions of the Data Controller in processing personal data.

§9 Security

We make every effort to protect users from unauthorized access, unauthorized modification, disclosure, and destruction of information in possession of H4H Recruitment Maria Kasperkiewicz. In particular:

we apply SSL encryption;
we control our methods of collecting, storing, and processing information, including physical security measures, to protect against unauthorized access to the system
