Information Clause Regarding the Conclusion of a Civil Law Contract

Based on Article 13, paragraphs 1 and 2, of the European Parliament and Council Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR), we inform you that:

  3. The purpose of processing your personal data is:

    • to conclude and execute a civil law contract with you or to take actions at your request prior to entering into a contract.

  4. Your personal data, and that of employees and representatives, will be processed:

  • when necessary for the performance of a contract or to take actions at your request prior to entering into a contract (according to Art. 6(1)(b) GDPR);

  • when necessary to comply with a legal obligation to which the controller is subject (according to Art. 6(1)(c) GDPR);

  • when necessary for the purposes arising from legally justified interests pursued by the controller (Art. 6(1)(f) GDPR);

  • in other cases, your personal data are processed only on the basis of previously given consent, to the extent and for the purpose specified in the content of the consent (according to Art. 6(1)(a) GDPR).

  1. The processing of personal data is primarily based on the Civil Code of April 23, 1964, and other universally applicable laws.

  2. We require the provision of a specific scope of personal data, which is:

  • voluntary, yet necessary to conclude and execute a contract;

  • voluntary when the processing of personal data is based on the consent of the person concerned;

  • necessary to perform tasks imposed on H4H Recruitment Maria Kasperkiewicz by applicable laws or performing tasks carried out in the public interest or in the exercise of official authority. Failure to provide data in the scope required by universally applicable regulations will result in the inability to take actions to properly consider the matter.

  1. We guarantee the fulfilment of your rights arising from the General Data Protection Regulation - GDPR. To exercise the following rights, please contact us via email: biuro@h4h.com.pl:

  • request access to your personal data, their correction, deletion, or restriction of processing;

  • object to the processing of your personal data;

  • transfer your personal data;

  • withdraw your consent to the processing of your personal data at any time without affecting the legality of the processing, which was performed based on consent before its withdrawal.

  1. If you believe that the processing of personal data by the Administrator is not in accordance with the applicable personal data protection laws, you have the right to lodge a complaint with the supervisory authority responsible for data protection, i.e., the President of the Office for Personal Data Protection (ul. Stawki 2, 00-193 Warsaw, Poland).

  2. The sharing of personal data by the Administrator is based on previously concluded data processing agreements (compliant with Art. 28 GDPR) and applicable legal provisions that may impose an obligation on the Administrator to disclose them. Your personal data may be shared with:

  • authorized entities by law – upon documented request;

  • IT system providers with whom the Administrator cooperates – to maintain continuity and correctness of system operations;

  • law firms, consultancy, and service firms;

  • postal or courier companies – for the delivery of correspondence;

  1. Your personal data will be processed for the duration of the contract and after its expiration for the period specified in specific regulations, including the period required to establish, defend, or claim rights and the retention period required by control authorities, in particular: the Social Insurance Institution and the Tax Office.

  2. Your personal data processed based on expressed consent will be stored until its withdrawal. Withdrawal of consent does not affect the legality of processing that took place based on consent before its withdrawal.

  3. The legitimate interest of the ADO is to establish, defend, and claim rights.
